1. Introduction and Acceptance of Terms
Welcome to SmartScape Robotics (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our robotic lawn mowing services, website, customer portal, and related services (collectively, the “Services”).
By accessing or using our Services, creating an account, or subscribing to our lawn care services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.
These Terms constitute a legally binding agreement between you and SmartScape Robotics. Please read them carefully.
2. Description of Services
2.1 Overview
SmartScape Robotics provides automated robotic lawn mowing services for residential properties. Our Services include:
- Robotic Lawn Mowing: Deployment and operation of Husqvarna Automower robotic mowing equipment at your property
- Bi-Weekly Detail Service: Human crew visits every two weeks for edge trimming, perimeter weeding (within 3 feet of beds and structures), and quality assurance
- Equipment Maintenance: Ongoing maintenance, blade replacement, software updates, and winterization of robotic equipment
- Remote Monitoring: Fleet monitoring through Husqvarna Fleet Services platform
- Customer Portal Access: Online account management through our web application
2.2 Service Tiers
We offer multiple service tiers based on lawn size:
- Small: Lawns up to 4,000 square feet
- Medium: Lawns from 4,001 to 8,000 square feet
- Large: Lawns from 8,001 to 12,000 square feet
- Extra Large (XL): Lawns over 12,001 square feet (custom pricing applies)
Larger service tiers may include additional services such as storm cleanup. Specific inclusions will be confirmed during your site consultation.
2.3 Service Area
Services are currently available in select areas. Service availability at your property address will be confirmed during the site consultation process.
3. Account Registration and Security
3.1 Account Creation
To use our Services, you must create an account through our authentication provider, Clerk. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized access to your account
3.2 Account Responsibility
You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.
3.3 Eligibility
You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use our Services. By creating an account, you represent that you meet these requirements.
4. Service Enrollment Process
4.1 Site Consultation
Before service begins, we conduct a free site consultation at your property to:
- Assess lawn size and terrain
- Identify obstacles, slopes, and exclusion zones
- Determine appropriate equipment and service tier
- Provide a custom quote
4.2 Property Requirements
You represent and warrant that:
- You own the property or have written authorization from the property owner to engage our Services
- Your property has adequate electrical infrastructure (standard outdoor outlet) near the proposed charging station location
- Your property is suitable for robotic mowing equipment as determined during site consultation
4.3 Electrical Requirements
A standard outdoor electrical outlet is required near the charging station location. If installation is needed, an additional $150 surcharge applies, with SmartScape Robotics covering remaining electrician costs.
5. Subscription Terms and Billing
5.1 Subscription Model
Our Services operate on a monthly subscription basis. Your subscription includes:
- Continuous robotic mowing service
- Bi-weekly detail crew visits
- All equipment maintenance and repairs
- Remote monitoring and support
5.2 One-Time Setup Fee
A one-time setup fee is charged at the beginning of service to cover:
- Professional installation of boundary wires
- Charging station setup and configuration
- Initial equipment programming and testing
Setup fees vary by service tier and are disclosed during site consultation. Setup fees are non-refundable.
5.3 Monthly Billing
- Monthly subscription fees are billed in advance
- Payment is processed automatically on the same date each month
- All prices are in U.S. dollars
- Applicable taxes may be added to your charges
5.4 Payment Processing
Payments are processed securely through Stripe. By subscribing, you:
- Authorize recurring monthly charges to your payment method
- Agree to Stripe's terms of service
- Are responsible for keeping payment information current
5.5 Failed Payments
If a payment fails:
- Your service may be paused until payment is resolved
- We will attempt to notify you via email
- Continued payment failure may result in service cancellation
6. Cancellation and Refund Policy
6.1 Customer-Initiated Cancellation
You may cancel your subscription at any time through the Stripe billing portal accessible from your account. Upon cancellation:
- Service will continue until the end of your current billing period
- Your subscription will not renew
- Equipment collection will be scheduled
6.2 Prorated Refund on Termination
If SmartScape Robotics terminates your service (see Section 10), you are entitled to a prorated refund of your monthly subscription fee based on the remaining days in your billing period.
6.3 Non-Refundable Fees
The following are non-refundable:
- One-time setup/installation fees
- Electrical installation surcharges
- Any period of service already rendered
6.4 Equipment Collection
Upon cancellation or termination:
- SmartScape Robotics will schedule equipment collection
- You must provide reasonable access to the property for equipment removal
- Boundary wires may be left in place or removed at our discretion
- Property will be restored to a reasonable condition
7. Service Pause
7.1 Seasonal Pause
You may pause your subscription during off-season months (typically winter). During a pause:
- Monthly billing is suspended
- Equipment remains at your property
- Service resumes automatically when unpaused
7.2 Administrative Pause
We may pause your service due to:
- Payment failure
- Weather conditions
- Equipment maintenance requirements
- Other operational reasons
We will notify you of any administrative pause and work to resume service promptly.
8. Customer Responsibilities
8.1 Property Access
You agree to:
- Provide reasonable access to your property for service visits and equipment maintenance
- Ensure the charging station area remains accessible and clear
- Notify us of any changes to property access (gates, codes, etc.)
8.2 Lawn Condition
You are responsible for:
- Maintaining lawn conditions suitable for robotic mowing
- Removing debris, toys, and obstacles from the lawn before scheduled service
- Addressing pest infestations that may damage equipment
- Informing us of any planned landscaping changes
8.3 Equipment Care
While equipment is deployed at your property:
- Do not attempt to repair, modify, or tamper with the equipment
- Do not move the charging station without prior authorization
- Report any equipment damage or malfunction promptly
- Protect equipment from theft (theft is addressed in Section 9.2)
8.4 Safety
You agree to:
- Inform household members and guests about the robotic mower
- Supervise children and pets around operating equipment as appropriate
- Follow any safety guidelines provided by SmartScape Robotics
9. Equipment Ownership and Liability
9.1 Equipment Ownership
All robotic mowing equipment, charging stations, boundary wires, and related hardware deployed at your property remain the exclusive property of SmartScape Robotics. You have no ownership interest in any equipment.
9.2 Equipment Damage or Theft
You are responsible for equipment damage or loss caused by:
- Intentional misuse or tampering
- Negligence or failure to follow care guidelines
- Theft (if due to your failure to maintain reasonable security)
Normal wear and tear and manufacturer defects are covered by your subscription.
9.3 Equipment Removal
You may not:
- Remove equipment from your property
- Sell, lease, or transfer equipment
- Dispose of equipment
- Use equipment as collateral
10. Termination
10.1 Termination by Customer
You may terminate service at any time by canceling through your account billing portal or by contacting us directly.
10.2 Termination by SmartScape Robotics
We may terminate your service immediately or with notice for:
- Breach of these Terms
- Non-payment of fees
- Fraudulent or illegal activity
- Abuse of equipment or personnel
- Property conditions that endanger equipment or personnel
- Any reason with 30 days written notice
10.3 Effect of Termination
Upon termination:
- All rights granted to you under these Terms cease
- Outstanding balances become immediately due
- Equipment collection will be scheduled
- Prorated refunds will be issued where applicable (see Section 6.2)
11. Limitation of Liability
11.1 Service Limitations
You acknowledge that:
- Robotic mowers cannot replace all traditional lawn care activities
- Weather, terrain, and property conditions may affect service quality
- Equipment may occasionally require maintenance affecting service continuity
- Results may vary based on lawn condition and grass type
11.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTSCAPE ROBOTICS PROVIDES SERVICES “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.3 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTSCAPE ROBOTICS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Property damage beyond the scope of our negligence
- Damages arising from third-party actions or force majeure events
11.4 Maximum Liability
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11.5 Exceptions
Nothing in these Terms limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded by law
12. Indemnification
You agree to indemnify, defend, and hold harmless SmartScape Robotics, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your breach of these Terms
- Your violation of any law or third-party rights
- Your misuse of Services or equipment
- Your property conditions that cause damage or injury
13. Intellectual Property
13.1 Our Property
All content, features, and functionality of our Services, including software, text, graphics, logos, and trademarks, are owned by SmartScape Robotics or our licensors and are protected by intellectual property laws.
13.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our customer portal for personal, non-commercial purposes related to your subscription.
14. Privacy
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.
15. Dispute Resolution
15.1 Informal Resolution
Before filing any formal legal action, you agree to contact us at info@smartscaperobotics.com to attempt to resolve any dispute informally. We will work in good faith to resolve your concerns.
15.2 Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
15.3 Jurisdiction
Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Washington State. You consent to personal jurisdiction in these courts.
16. Modifications to Terms
16.1 Changes
We may modify these Terms at any time. Material changes will be communicated via email or through our customer portal at least 30 days before taking effect.
16.2 Continued Use
Your continued use of Services after changes take effect constitutes acceptance of the modified Terms. If you do not agree to changes, you must cancel your subscription before they take effect.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and SmartScape Robotics regarding the Services.
17.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
17.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
17.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
17.5 Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.
17.6 Notices
